根據 Google 的使用條款（GOOGLE TERMS OF SERVICE， 2024 年 5 月 22 日之更新版本），Google 旗下產品（包含 Gemini）所生成的內容，有幾點較值得留意：
Google 不擁有生成的內容
Google 不會主張對 AI 生成內容的權利，但也未明確說明 AI 產生內容之權利歸屬。
Some of our services allow you to generate original content. Google won’t claim ownership over that content.
另外，在 Gemini API 的附加使用條款（Gemini API Additional Terms of Service）中，則提到 Google 可能會為他人生成相同或相似內容。
You acknowledge that Google may generate the same or similar content for others and that we reserve all rights to do so.
使用者不可利用生成的內容來訓練 AI
Google 未說明使用者可以如何使用 Gemini 所生成的內容，但有明確限制使用者不可以利用 Google AI 服務所生成的內容，來開發其他與 Google 競爭的 AI 技術。這是規定在濫用 Google 服務的態樣中：

AI 生成內容之標示
Google 並未特別要求使用者在發佈 AI 生成之內容時，要對內容進行標示。但要求使用者不得誤導他人 AI 生成之內容是由人類所創作。這被認為是一種利用 Google 系統的欺詐行為：
- misleading others into thinking that generative AI content was created by a human
對企業客戶的服務提供擔保（indemnification）
在客戶使用 Google AI 服務所生成的內容時，有可能侵犯第三方的著作權。對此 Google 提供了雙重擔保政策，涵蓋 AI 系統在訓練和生成兩個階段可能引發的侵權風險。
較須注意的是，這只適用於使用 Google Cloud 和 Workspace 中 AI 服務（例如Vertex AI、Duet AI）的企業用戶，對於個人開發者和創作者而言，保護的範圍較為有限。
訓練資料擔保
如果使用者因為 AI 模型背後的訓練資料導致被控侵權，Google 將提供法律保護。
Specifically, our training data indemnity covers any allegations that Google’s use of training data to create any of our generative models utilized by a generative AI service, infringes a third party’s intellectual property right.
生成結果擔保
如果是因為 AI 服務生成的內容而遭到侵權指控，Google 也將為用戶承擔相應的法律責任。與前一項擔保較為不同的是，由於用戶也參與了內容的生成，所以如果用戶刻意生成會侵權的內容，則無法得到此擔保的保障。
The generated output indemnity provides you with a second layer of protection, as the generated output is created by our customers in response to prompts or other inputs that they provide to our services. With this second layer of protection, our indemnity obligations now also apply to allegations that generated output infringes a third party’s intellectual property rights.
An important note here: you as a customer also have a part to play. For example, this indemnity only applies if you didn’t try to intentionally create or use generated output to infringe the rights of others, and similarly, are using existing and emerging tools, for example to cite sources to help use generated output responsibly.
